Booking a trip - Terms and Conditions
These Terms and Conditions outline your rights and responsibilities when booking a trip with Happy Hour Travel. By making a booking, you acknowledge that you have read, understood, and agreed to these Terms.

Note on Terminology
For purposes of these Terms and Conditions, the terms “you”, “your”, or “client” refer to the individual making the booking as well as all other passengers or travelers listed on the booking, whether or not they are named individually. By booking through Happy Hour Travel, you represent that you have the authority to accept these Terms and Conditions on behalf of all travelers associated with this booking.

1. Understanding Your Purchase
You confirm that you understand what is included and excluded in your travel arrangements, including all prices, deposits, final payment dates, cancellation/change policies, and applicable fees.
You are responsible for reviewing your itinerary for accuracy (e.g., names, dates of birth, travel dates, hotel selections). Happy Hour Travel must be notified of any errors within 24 hours of booking; otherwise, changes may incur fees and/or fare differences.
Happy Hour Travel provides support during defined business hours (Mon-Fri, 9 am–5 pm EST). Support outside these hours is reserved for true travel emergencies only.
Payments to travel suppliers are processed directly through those suppliers. Happy Hour Travel collects only our service fees for planning and booking services.

2. Credit Card Authorization
You authorize the use of the credit card(s) provided for booking deposits, payments, and final balances, unless otherwise stated. You may update your card by contacting us at least 7 business days before the payment date.2.1 Chargebacks
Disputing a legitimate, authorized charge (a "chargeback") is considered a breach of this agreement.
If you have concerns about any charge, you must contact Happy Hour Travel directly before initiating a chargeback with your credit card company. Improper chargebacks may result in:
Immediate cancellation of your travel arrangements
Forfeiture of all payments made
Collection action for amounts owed plus administrative fees
Liability for our costs in responding to the chargeback, including legal fees
We reserve the right to pursue all available legal remedies for fraudulent or improper chargebacks.
3. Airfare Bookings
Airline tickets are governed by the carrier’s own rules and restrictions. Most fares are non-refundable, non-transferable, and subject to fees for changes.
You are responsible for any costs incurred due to modifications, including name corrections, schedule changes, or route adjustments.
Happy Hour Travel isn’t responsible for airline changes that frustrate travelers, including things like schedule changes, seat assignments, and baggage fees. Our role is to facilitate the booking - not guarantee what the airline ultimately provides. The actual product and service provided by the airline is solely their responsibility.

4. Hotel Bookings
Hotel star ratings are based on local standards and may vary by country. Descriptions and photos are for informational purposes and may not reflect the current conditions.
In rare cases, accommodations may be substituted by the hotel due to force majeure or operational issues. Happy Hour Travel will inform you if notified in advance, but some changes may occur upon check-in without prior notice.
5. Tours and Activities
Some activities may not be suitable for all ages or health conditions. You assume responsibility for selecting appropriate activities.
Activities may be unavailable due to weather, low participation, seasonality, or operational issues. Happy Hour Travel is not liable for changes or cancellations beyond our control.
6. International Travel Requirements
You are responsible for ensuring all travelers have valid documentation, including passports, visas, vaccinations, and entry permits.
Names on travel documents must match legal IDs (passport for international travel, government-issued ID for domestic travel).
Visit https://travel.state.gov or consult your destination’s consulate for requirements.
Entry may be denied for incomplete or incorrect documentation, and you assume all associated risks and costs.
7. Travel Insurance
We strongly urge you to purchase comprehensive travel insurance that includes trip cancellation, trip interruption, medical coverage, and other protections. You are responsible for understanding your policy's coverage, terms, and exclusions.
Happy Hour Travel may sell insurance policies, but cannot answer specific coverage questions or file claims on your behalf. All inquiries must be directed to the insurance provider.
If you decline travel insurance, you accept full financial responsibility for any losses incurred due to cancellation, regardless of the reason.

8. Payment Terms and Fees
8.1 Service Fees
Happy Hour Travel charges professional planning and booking fees for our services. These fees are separate from the cost of travel suppliers (airlines, hotels, cruise lines, tour operators, etc.) and are detailed in your booking confirmation or quote.
Service fees are non-refundable once booking work has commenced, regardless of whether you proceed with the trip or cancel your travel arrangements.
8.2 Payment Schedule
Payment terms, including deposit amounts and final payment deadlines, vary based on your specific travel arrangements and supplier requirements. Your personalized payment schedule will be provided in writing at the time of booking.
It is your responsibility to make all payments by the deadlines specified in your booking confirmation. Failure to meet payment deadlines may result in cancellation of your reservation, forfeiture of deposits, and additional cancellation fees.
8.3 Price Increases
Prices are subject to change until the deposit or final payment is received. After payment is done, prices may still increase, although they are unlikely, due to factors beyond our control, including but not limited to:
Government-imposed taxes and fees
Currency exchange rate fluctuations
Fuel surcharges imposed by airlines or cruise lines
Supplier price adjustments
We will notify you of any such increases as soon as we are informed. You will be responsible for paying these additional costs.
8.4 Late or Failed Payments
If a scheduled payment is not received by the due date or a credit card payment is declined, we will make reasonable efforts to contact you, but it is your responsibility to make sure the payment is confirmed by the due date. Failure to provide payment risks your booking being cancelled by suppliers, and all deposits and payments made until that date may be forfeited. You will be responsible for any cancellation penalties imposed by suppliers
9. Cancellations
If you need to cancel your trip, you will be subject to the supplier's cancellation policy. Depending on when the cancellation is made and the type of trip you have booked, you may or may not be entitled to a full or partial refund based on the suppliers' penalties. Whatever the case may be, Happy Hour Travel will work on your behalf to cancel the trip with the best possible outcome for you. However, in certain situations, the payments will be non-refundable, and Happy Hour Travel shall not be responsible for the lost money.
All cancellation requests must be submitted in writing via email. Cancellations are effective on the date we receive your written request during business hours.
9.1 Refunds
If you are entitled to any refund from travel suppliers:
Refunds are subject to the individual supplier's processing timeline, which typically ranges from 60-90 days but may take longer
We will submit refund requests on your behalf, but we cannot guarantee the approval, amount, or timing of any refund.
Refunds will be issued in the same form of payment originally used.
Some suppliers may issue travel credits or vouchers instead of monetary refunds.
Service fees paid to Happy Hour Travel are non-refundable.

9.2 No-Shows and Unused Services
If you fail to show up for any reserved service (flights, hotels, tours, etc.) or do not use services you have purchased:
You will be considered a "no-show" and will forfeit 100% of the cost
No refunds will be provided for unused services, missed connections, or voluntary changes to your itinerary
You remain responsible for any outstanding balances owed

9.3 Changes and Modifications
Any changes or modifications to your booking after initial confirmation may incur:
Happy Hour Travel's modification/change fee (amount specified in your booking confirmation)
Supplier change fees and penalties
Fare differences or rate increases
Additional taxes and fees
Some bookings cannot be changed and must be cancelled and rebooked, resulting in full cancellation penalties plus new booking costs.
9.4 Cancellation by Happy Hour Travel
We reserve the right to cancel your booking if:
Payment deadlines are not met
You provide false or misleading information
You violate these Terms and Conditions
Circumstances make it impractical or unsafe to proceed
In such cases, you will receive a refund of payments made to suppliers (minus their cancellation penalties), but Happy Hour Travel's service fees are non-refundable.

10. Liability Waiver
You understand and acknowledge that participation in travel involves inherent risks. Happy Hour Travel is not liable for injury, illness, loss, damage, theft, or death that may occur during your trip.
You agree to release Happy Hour Travel from all claims arising from the actions of third-party suppliers, including transportation, lodging, food services, and activities.

11. Role of Happy Hour Travel
Happy Hour Travel acts solely as an agent for suppliers such as airlines, cruise lines, tour operators, and hotels. We do not own, operate, or control these entities.
We are not responsible for supplier errors, service failures, changes to itineraries, overbookings, bankruptcies, or force majeure events.

12. Limitation of Liability
Happy Hour Travel shall not be liable for any damages or delays caused by:
Acts of God or government
War, civil unrest, terrorism
Weather, mechanical issues, or labor strikes
Health outbreaks or pandemics
Transportation issues, lost luggage, or supplier failure
You agree to assume these risks and understand they may impact your travel plans.

13. Changes to Terms
These Terms and Conditions may be updated at any time without prior notice. It is your responsibility to review them before making a new booking.

14. Acceptance of Terms
By booking a trip with Happy Hour Travel, you acknowledge and agree to these Terms and Conditions. Failure to accept these terms may result in booking cancellation.

15. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

16. Headings
Section titles are for convenience only and do not affect interpretation.

17. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law provisions. Any legal disputes will be resolved under North Carolina law.
18. Jurisdiction and Venue
You agree that any legal action, suit, or proceeding arising out of or relating to these Terms and Conditions, your booking, or services provided by Happy Hour Travel must be brought exclusively in the state or federal courts located in Union County, North Carolina. You hereby consent to the personal jurisdiction of such courts and waive any objection to the venue in such courts on the grounds of inconvenient forum or otherwise.
19. Dispute Resolution and Arbitration
19.1 Informal Resolution
Before initiating any formal legal proceedings, you agree to first contact Happy Hour Travel in writing to attempt to resolve the dispute informally. We will make good-faith efforts to resolve your concerns within 30 days of receiving written notice.
19.2 Binding Arbitration
If informal resolution is unsuccessful, any dispute, claim, or controversy arising out of or relating to these Terms and Conditions or your booking shall be settled by binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules.
The arbitration shall take place in Union County, North Carolina, or at another location mutually agreed upon by both parties. The arbitration shall be conducted by a single arbitrator.
Each party shall bear its own attorney's fees and costs, except that the arbitrator may award fees and costs to the prevailing party if permitted by applicable law.
19.3 Class Action Waiver
YOU AGREE THAT ANY ARBITRATION OR LEGAL PROCEEDING SHALL BE CONDUCTED ON AN INDIVIDUAL BASIS ONLY AND NOT AS A CLASS ACTION, CONSOLIDATED ACTION, OR REPRESENTATIVE ACTION. You waive any right to participate in a class action lawsuit or class-wide arbitration.
19.4 Exceptions to Arbitration
Notwithstanding the above, either party may bring an action in small claims court if the claim qualifies. Additionally, either party may seek injunctive or equitable relief in court to prevent unauthorized use of intellectual property or confidential information.
19.5 Waiver of Jury Trial
To the extent arbitration does not apply, both parties waive any right to a jury trial in any legal proceeding arising out of or relating to these Terms and Conditions.
20. Time Limitation on Claims
You agree that any claim or cause of action arising out of or relating to these Terms and Conditions or your travel arrangements must be filed within one (1) year after the claim or cause of action arose. After this period, such claims are permanently barred.
21. Attorney's Fees
In the event of any legal action or arbitration to enforce these Terms and Conditions, the prevailing party shall be entitled to recover reasonable attorney's fees and costs from the non-prevailing party.

22. Indemnification
You agree to indemnify and hold harmless Happy Hour Travel from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from:
Your violation of these Terms and Conditions
Your violation of any supplier rules or local laws during travel
False or misleading information you provide
Your conduct that causes harm to Happy Hour Travel's reputation or business relationships
