Booking a trip - Terms and Conditions
I know these are usually the sort of things we skip reading due to the lengthy wording but I do need to ask you to check all the below terms and conditions regarding booking your trip. These will cover the majority if important items regarding your rights and responsibily when booking a trip with Happy Hour Travel.

> Knowledge of what you are buying.
The client understands all the aspects of purchasing this trip, including but not limited to, what's included, what's not included, the prices, deposits, final payment dates, cancellation and change policies and fees.

You reviewed the itinerary for accuracy and requested any correction such as spelling of names, date of birth, dates of travel, hotels picked, and other aspects, to be sure everything is correct to your liking. As I deal with several bookings per day, it's the client's responsibility to double-check all their information. Errors not bought to my attention within a 24-hour period from booking will incur fees and possibly fare difference. This is necessary to ensure everything goes as planned and avoid any "surprises" along the way.

> Credit card approval.
The client approves the use of his/her credit card given to Happy Hour Travel to be used for the chosen bookings, for deposit and final payment, unless otherwise noticed. You can always change the credit card you want to use by communicating with Happy Hour Travel.
Happy Hour Travel never collects payment. All payments are made directly to the suppliers and/or vendors chosen during the trip planning process.
Also, the client shall not dispute a credit card charge that was communicated, as the chargeback process causes a lot of damage to the travel agent involved. If there is a charge related to this trip that doesn't seem right or maybe even a refund that you are entitled to but are experiencing delays, please reach out to me so I can check the situation and help you find the best course of action.

> Air bookings.
Please understand that airlines have their own set of rules and it's the client's responsibility to comply with them. Airline tickets are highly restrictive, non-refundable, and non-transferable. Any changes made to flights, like name correction, date of travel, destination change, will incur in fees placed by the airlines themselves.

> Hotel bookings.
The number of stars attributed to the hotels and other providers of accommodations booked by Happy Hour Travel corresponds to a classification established as a point of reference in accordance with local standards in the host country. These classifications may change from country to country.
The comments made in the accommodation descriptions are based on my knowledge of the establishments, my clients' past experiences, and my research about that hotel. Therefore, Happy Hour Travel makes no guarantee that its descriptions and photographs are an exact representation of what you will find.
In exceptional circumstances, a hotel might replace your accommodation type or even location. This is not something that happens frequently, it's just in cases of force majeure and you will be informed as soon as we are aware of this necessity.
> Activities and tours.
An activity may not be appropriate for all ages or for individuals with certain medical conditions. Happy Hour Travel may not be held liable in the event of an incident or accident which is due to a lack of vigilance on the client's part.

It may happen that certain activities referred to in the Trip description are no longer provided by the local provider for climatic reasons, in the event of force majeure, during a stay out of the peak season, or when the minimum number of participants required for providing a given activity is not reached.

Some activities and or facilities may not be available at all times and some might be closed due to maintenance work or renovation. On the other side of the spectrum, you may also experience activities or facilities that are sold out and/or full.

> International bookings.
Passengers are responsible to ensure that they have all the proper documents for entry. All names on documents must match the legal name on your photo I.D., and travel document information must match tickets. Please check the State Department website at https://travel.state.gov for further information. Immunizations may also be required. Failure to comply with these regulations may result in denied boarding, denied entry, and/or government-imposed fines. If you are a citizen of another country, there may be additional requirements, please check directly with your nearest consulate or embassy to find out the entry requirements.
> Travel insurance:
The client understands all the inclusions and exclusions when choosing to buy travel insurance, or when choosing to deny one. If buying travel insurance, It is the client's total to check all the coverages involved in his/her travel insurance plan. As a travel agency, Happy Hour Travel is allowed to sell travel insurance but it is now allowed to answer specific questions about the coverage of the insurance, nor is allowed to file claims in the client's name. All the specific questions about coverage need to be dealt with the travel insurance company directly.
The client also understands that if he/she chooses not to purchase travel insurance, ​he/she is accepting the terms and conditions of the travel suppliers with the changes and cancellation fees imposed by them.

> Personal injuries or loss suffered:
You acknowledge that the use or enjoyment of a flight, accommodation, an activity, our tour may be hazardous and inherently risky and to the maximum extent permitted by law, Happy Hour Travel shall have no liability for any personal injury, death, lost, stolen, damaged, or destroyed property, or other liability arising out of or in connection with the use and operation of anything related to this trip, and all actions or events occurring prior to, during, at, or after the trip.

> Agent / Intermediary:
Happy Hour Travel is simply an intermediary between the Suppliers and the public. Happy Hour Travel does not own or operate any hotels, shore excursions, tours, transportation providers, cruise lines, vessels, airlines, travel protection companies, attractions, or other travel-related Suppliers who provide goods or services for the Passenger(s)’ trip. Passenger(s) acknowledge and agree that Happy Hour Travel shall not be responsible for any loss, damage, delay, inconvenience, or injury to Passenger(s) or group members as a result of a breach of contract, act, or omission.

Suppliers reserve the right to deviate from the direct, customary, and/or scheduled route or itinerary for any reason, without limitation, and without notice, and passenger(s) acknowledge and agree that Happy Hour Travel is not responsible for that. Happy Hour Travel is also not liable for any loss due to Passenger’s gambling and is not responsible for any purchases made while on the trip.
While Happy Hour Travel prides itself on selecting top quality Suppliers, no undertaking, guarantee, or warranty is given or shall be implied as to the fitness or condition of the Supplier’s accommodations, transportation, or any food, drink, medicine, or provisions supplied.
Passenger(s) acknowledge and agree that Happy Hour Travel shall not be responsible for refunding, either fully or partially, any amounts paid due to unsatisfactory services from any supplier. In no event shall Happy Hour Travel be liable for any accident which occurs in hotels, in resorts, on airplanes/in airports, on buses/in bus stations, on trains/in train stations, on board a cruise ship, on tenders, on shore excursions, or during any mode of transportation encountered during the trip, resulting from equipment or any other cause. The Passenger admits a full understanding of the nature and character of the mode of transport and assumes all risks of travel, transportation, and handling of passengers and baggage.
> LIMITATION OF LIABILITY:
Without limitation, Passenger(s) assume the risk of, and agree that Happy Hour Travel is not liable for any damages arising from or related to any act of God or public enemies, arrest, restraints of any government or rulers of people, piracy, war, revolution, extortion, terrorist activity, threatened or actual rebellion, political upheaval, civil unrest, riots, fire, lockouts, explosion, collision, weather conditions, dangers incident to the sea, mechanical or construction failures or difficulties, diseases, local laws, abnormal conditions or developments, closure of airports/seaports/hotels/train stations, carrier or supplier logistical problems, computer problems stranding, food or water poisoning, illness, grounding, perils of the sea, rivers, canals, locks or other waters, perils of navigation of any kind, theft, accident to or from machinery, boilers, or latent defects even though existing at the commencement of the trip, desertion or revolt of the crew, or lost/damaged/delayed luggage.

> MODIFICATION OF TERMS AND CONDITIONS:
The Terms and Conditions may be amended or modified by Happy Hour Travel at any time without notice. It is therefore essential that you consult the Terms and Conditions prior to making each and every booking, particularly in order to ensure what provisions are in operation in case they have changed since the last time an order was placed by you.

Only those who have accepted the Terms and Conditions and affirmatively indicated their consent to be bound by the Terms and Conditions may make a booking with Happy Hour Travel. Without this acceptance, any order is subject to cancellation at any time.
The failure of Happy Hour Travel to act with respect to a breach of these Terms and Conditions by you, or others, does not waive its right to act with respect to subsequent or similar breaches. Happy Hour Travel does not guarantee it will take action against all breaches of these Terms and Conditions.
> SEVERABILITY:
If any provision of this agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions.

> HEADINGS:
Headings are for reference purposes only and do not limit the scope or extent of such section.
